This is an Agreement (“Agreement”) between Lane Crawford (Hong Kong) Limited (“Lane Crawford”) (having its registered office at 30/F, One Island South, 2 Heung Yip Road, Wong Chuk Hang, Hong Kong SAR) and you (“the Cardholder” or “you”).

Lane Crawford Privilege Programme

1. The Lane Crawford Membership Card (including Lane Crawford Beauty+ Membership Card, Lane Crawford Privilege Membership Card, Lane Crawford Gold Membership Card, Lane Crawford Platinum Membership Card and such other membership card(s) as may be designated by Lane Crawford from time to time) in physical or digital form (“the Card”) is issued by Lane Crawford. You may be eligible for certain benefits by being issued with the Card subject to Lane Crawford’s sole discretion from time to time. All Card benefits (as well as any further terms regarding how you can access such benefits as a holder of the Card or otherwise applicable to such benefits, such further terms being incorporated by reference into this Agreement) are listed at www.lanecrawford.com/privilegecard. The Card (including its possession of and use by you) shall be subject to the Terms & Conditions of this Agreement in effect at the time of use of the Card by you.
2. To the maximum extent permitted by law, nothing contained in this Agreement shall affect Lane Crawford’s right to revise the Terms & Conditions of this Agreement (including amending any of the Card’s benefits or how you can access such benefits) at any time at its sole discretion, except that Lane Crawford will inform you within a reasonable period of time and in a reasonable manner of any changes to this Agreement if such changes will limit the benefits you may receive from the Card (as described in clause 1 above). You may access the current version of this Agreement at www.lanecrawford.com/privilegecard, so please do check back from time to time for updates. By continuing to use the Card, you are agreeing to continue to be bound by this Agreement as revised.

The Card

3. The issuance of the Card will be at Lane Crawford’s sole discretion. Lane Crawford may issue you with a provisional card pending issuance of the Card (the use of which is also subject to this Agreement). Upon the issuance of the Card, any provisional card which may have been issued by Lane Crawford to the Cardholder (which use is also subject to this Agreement) will be cancelled and replaced by this Card and become null and void and have no further effect whatsoever. This Agreement applies from the date on which any provisional card or the Card (whichever was issued earlier) is issued to the Cardholder (“Commencement Date”) to the date of termination in accordance with clause 4 of this Agreement.
4. The validity period of the Card is for 12 months from the Commencement Date, and may be renewed for further 12 month periods by Lane Crawford in its sole discretion/subject to your fulfillment of the criteria set out at www.lanecrawford.com/privilegecard upon written notice to you. The Card may be cancelled and this Agreement may be terminated by either: (a) Lane Crawford at any time (at its sole discretion) without any reason upon giving written notice to the Cardholder; or (b) Lane Crawford not renewing the Card at the end of any 12 month period of the Card, upon giving written notice to the Cardholder that they have not fulfilled the criteria for renewal set out at www.lanecrawford.com/privilegecard.
5. The Card is not a credit card or a charge card and confers no right or benefit upon the Cardholder to purchase goods or services on credit or on terms other than those specified in this Agreement.
6. The Cardholder shall keep the Card under their personal control at all times. The Card is personal to the Cardholder and is not transferable to any other person. The Cardholder shall not be entitled to receive any benefits conferred by the Card unless the Card or QR code is presented and payment is effected in person by the Cardholder.
7. PLEASE RECORD YOUR ACCOUNT NUMBER AND KEEP IT IN A SECRET AND SECURE PLACE. You must maintain secure possession of the Card at all times. The Cardholder will notify Lane Crawford in writing of any changes in their contact information.
8. The Card may only be used for personal purchases and cannot be used for any commercial or promotional purpose or any other purpose whatsoever unless authorized by Lane Crawford in writing.

Disclaimers

9. We (including our directors, officers, agents, consultants and associates, along with our related companies (including affiliate and subsidiary companies)) are not liable to you for any loss, damage or liability (whether direct, consequential, indirect, economic or otherwise) incurred by you in relation to the Card, including in relation to: (a) your use of the Card, (b) if the Card is used by any third party, whether with or without your permission; (c) your loss of the Card (or any liability incurred via your loss of the Card, whether before or after you notify us regarding your loss of the Card); (d) any revisions to the Terms and Conditions of this Agreement (including revisions to any of the Card’s benefits); or (e) any cancellation of the Card.

Violation of Lane Crawford Policies etc.

10. Any customer who violates relevant policies of Lane Crawford (as maybe in effect from time to time), abuses Lane Crawford Returns Policy (including without limitation demonstrating a high incidence of returns of Merchandise after purchase, or engages in inappropriate behaviour (including without limitation abuse of Lane Crawford staff), or illegal activities (including parallel importing or passing off of Product purchased at Lane Crawford by the customer) may suffer the following consequences:
    1. The customer may be blacklisted by Lane Crawford;
    2. Lane Crawford may not accept future orders from the customer;
    3. Lane Crawford may decline the customer’s request to return or exchange any Merchandise;
    4. If the customer is a holder of the Card, he/she may be disqualified from the Lane Crawford Privilege Programme; or
    5. If the customer is not a holder of the Card, he/she may be barred from joining the Lane Crawford Privilege Programme.
    
    The decision as to whether a customer has violated relevant policies of Lane Crawford (as maybe in effect from time to time) or abused Lane Crawford Returns Policy or engaged in inappropriate behavior or illegal activities remains within Lane Crawford’s sole discretion and its decision shall be final. Suspected illegal activities will be referred to Lane Crawford’s legal department for further investigation and action.

General Terms and Conditions

11. Any personal data which you provide to Lane Crawford in your application for or use of the Card will be collected, used and stored in accordance with our Privacy Policy available at www.lanecrawford.com/privacy.
12. By continuing to use the Card, you expressly agree to provide to Lane Crawford, and/or to authorise Lane Crawford to use, your personal information, for the purpose of performing appropriate security checks, such as credit checks and also to, where necessary, transmit or obtain information about you to or from third parties including (but not limited to) credit reference or fraud-prevention agencies, which may keep a record of that information.
13. In the event of any discrepancy between the information on the Card and the Lane Crawford system, the information on Lane Crawford system shall prevail.
14. In case of any dispute, Lane Crawford reserves the right of final decision. This Agreement shall be governed and construed in accordance with the laws of Hong Kong Special Administrative Region (including where any issue arises in respect to the use of the Card in the People’s Republic of China).
15. In the event of any discrepancy or conflict between different language versions of this Agreement, the English version shall prevail.

NOTES

Note 1: Qualifying spending by a customer in Lane Crawford’s offline stores, online store and/or affiliated boutiques for the purpose of maintaining such customer’s membership status, or upgrading such customer’s membership status to the next membership tier, (“Qualifying Spending”) will be accumulated from (and including) (i) the date of such customer’s card issuance or status upgrade/renewal (as the case maybe) (where the month in which such date falls is the “Qualifying Commencement Month”) until (and including) (ii) the last calendar day of the 12th month after the Qualifying Commencement Month. For example, if a customer’s membership card is issued (or his/her membership status is upgraded/renewed) on 15 September 2022, then such customer’s Qualifying Spending will be accumulated from 15 September 2022 until (and including) 31 August 2023.

Note 2: Payments by Gift Card and purchase of Samsung products are not eligible for Rewards Points.

Note 3: Rewards Points issued have a validity period of 12 months from the date of issue. Rewards are issued in the form of Gift Cards (“Reward GC”). Reward GC is issued when 8,000 Rewards Points or multiples of 8,000 are accumulated (subject always to Lane Crawford’s sole discretion from time to time). Balance of unused Rewards Points will be carried forward until the Rewards Points expire. Rewards will be issued 4 times a year as designated by Lane Crawford based on membership tier as at the time of issuance. Currency of reward is based on the location of card issuance. Reward GC must be collected within 3 months from the date of initial notification. Reward GC that is not collected within 3 months from the date of initial notification will be forfeited. Reward GC issued must be used within 6 months from the date of initial notification and, subject to the aforesaid, its use is also governed by the terms and conditions www.lanecrawford.com.hk/info/help/gift-card-terms/digital-gift-card/.To be eligible for Rewards Points, the name on the credit card used for the transaction must correspond with the Lane Crawford account name.
